Project
The Designer agrees to provide graphic design services as listed in the “deliverables” section of your invoice. The Designer agrees they will remain the sole provider for the term of this project. All work will remain unique, original, and free of any plagiarism.
Scope of Work
If the scope of work changes during the project’s completion, i.e. if the client is requesting any other services or work not outlined in the initial proposal, additional costs may occur. Any price changes will be communicated to the client prior to beginning such tasks.
Revisions Policy
As outlined in the project proposal and in the deliverables above, the client is entitled to a set amount of complimentary revisions. If the Client requires additional revisions or the development of other assets, it is considered beyond the “Scope of Work” and the designer will bill an hourly rate of $30/hr for any ongoing work beyond.
A revision constitutes a change or variation to an initially presented or in-progress design concept, and is typically a change of less than 1/4 of the design. A revision is simply meant to be a slight modification or course correction to progress toward the final design.
Cancellation
Should the client choose to cancel the project before it’s completion, the client will be invoiced for everything produced up to that point. Should the client choose to cancel this project after the project’s completion, the client will remain responsible for full payment of the complete project total. No artwork will be submitted for incomplete projects.
Late Fees
For any uncommunicated and non-approved late payments, the client is liable to pay a 10% late fee for each week exceeding the due date mentioned on the invoice.
Errors/Proofing
The client is liable and responsible for proofing any content that they provide.
Materials Supplied By The Client
All materials (images, videos, media, content etc) supplied by the client is to be obtained rightfully and comply with copyright law. Ensuring that the materials that are being sent to the designer are legal and are licensed to use for the project are the client's sole responsibility. The designer will not be liable for any copyright infringement on materials that are supplied by the client.
Dormancy Clause
I understand that sometimes life happens and you may need to pause work on your project. That is completely acceptable if I’m notified and made aware of your situation in advance. If your project goes more than 30 days without any forward progress or significant activity from your end, and no prior arrangements have been made with me and agreed to, you will be billed for the work completed up to that point and your project will be put on hold. All associated files will be saved and kept by myself, the designer. No artwork will be submitted for incomplete projects. When your project is ready to be continued, additional fees will be required to restart your project and it will be scheduled into my current workflow where space is available.
Dormancy Cancellation Clause
If your project remains inactive for an additional 15 days past the 30 day dormancy period (45 days total) with no significant forward progress made, milestones reached, or prior arrangement/ communication in place, our engagement will expire, no refunds will be available, and you will forfeit all deliverables associated with this client agreement. Basically, if you disappear for 45 days, or delay the project with no forward movement and no communication for 45 days, this project will be canceled and no refunds will be given.
Ownership of Materials
The client will be the sole and exclusive owner of the digital and physical materials created by the designer. However, the designer maintains the credits and rights as the creator of these materials. Furthermore, the work created can be added to the designer’s work portfolio or for other marketing strategies that are used to gain more clients.
